We, the people of Vestina, regardless of language, gender, race, nationality, religion and on the basis of personal choice, conviction and will, in the pursuit of:


- to create a society that is moral, just, peaceful, striving for constant development and self-improvement, based on unity and equality of dignity of each person,


We are creating a Digital State, the Republic of the Vestina, and we accept this Constitution as a fundamental document.

CHAPTER 1. DECLARATION OF STATE SOVEREIGNTY OF THE DIGITAL STATE OF THE REPUBLIC OF VESTINA




 

 

CHAPTER 2. GENERAL PROVISIONS

Article 1. Name of the State

1. The official name of the state is the Digital State of the Republic of Vestina.

2. The names "Digital State of the Republic of the Vestina", "Republic of the Vestina" and "Vestina" are equivalent.

 

Article 2. The status of the State and the main provisions of its activities

1. The Republic of Vestina claims to be a sovereign, digital, free, unitary, legal, fair, socially oriented, secular state, independent of territorial affiliation and language barriers.

2. The Digital State of the Republic of Vestina has a presidential form of government.

3. The state power in the country is unified. The Constitution has the highest legal force.

4. The Republic of Vestina recognizes political and ideological diversity.

5. In the Republic of the Vestina, private and State property are equally recognized and protected.

6. The official language is Russian. English has the status of an integration language.

7. The national currency is the Delmar ζ.

Article 3. Higher values

1. The highest values of the Republic of Vestina are:

           I. Man, his life, rights and freedoms;

           II. The rule of law;

           III. Morality, justice;

           IV. Freedom of society and the state.


2. The Constitution, the legislation of the Republic, and state bodies are obliged to protect the highest values.

Article 4. Digital citizenship of the Republic of Vestina. The rights of citizens.

1. Citizenship of the Republic of Vestina is acquired and terminated in accordance with the Law "On Digital Citizenship of the Republic of Vestina";

2. In the Republic of Vestina, all citizens' rights are equally recognized and protected. Every citizen has the right to independently protect their rights from violations and encroachments;

3. Everyone is equal before the law and the court;

4. Human dignity is inviolable;

5. Everyone has the right to life, privacy, personal and family secrets, the secrecy of personal deposits and savings, the secrecy of correspondence and telephone conversations, as well as the protection of digital property;

6. Freedom of speech is recognized in the Republic of Vestina. Censorship is prohibited;

7. Everyone has the right to freedom of religion and conscience;

8. A citizen has the right to elect and be elected;

9. A citizen has the right to access open information about the activities of state bodies and participate in public control;

 

Article 5. Duties of citizens of the Republic of Vestina​

1. The duties of a citizen of the Republic of the Vestina arise from the moment of acquisition of the citizenship of the Vestina;

2. A citizen of the Republic of Vestina is obliged to:

1) Respect the rights and freedoms and legitimate interests of other citizens of the Republic of Vestina;

2) Comply with the Constitution and legislation of the Republic of Vestina.

 

Article 6. Guarantees of ensuring the rights and freedoms of citizens and their protection

1. The State guarantees the rights and freedoms of a citizen;

2. The State is fully responsible for observing, ensuring and protecting the rights and freedoms of a citizen;

3. The state guarantees the possibility of repealing a particular regulatory legal act if more than half of the citizens disagree with it.​

CHAPTER 3. POWER, DEMOCRACY AND PUBLIC ADMINISTRATION

SECTION I. State power and its sources

Article 7. The source of State power

The source of power in the Republic of Vestina is the people.

Article 8. Implementation of the principle of democracy​

1. Every citizen has the right to participate in the management of State affairs both directly and through his representatives;

2. Democracy in the Republic of Vestina is exercised through participation in elections, referendums, interaction with state bodies and participation in public control;

3. Elections of state bodies, referendums and other electoral processes are carried out exclusively with the use of electronic technologies;

4. Interference of state bodies and their representatives in electoral processes, the use of any kind of pressure and coercion against citizens and employees of authorized bodies of the electoral process is unacceptable.

Article 9. State power ​

1. State power in the Republic of Vestina is exercised by dividing it into legislative, executive, and judicial;

2. The legislative power is exercised by the Parliament - the Garacium;

3. Executive power is exercised by the Government of the Republic of Vestina.

4. The Head of State does not belong to any of the three branches of government;

5. The State power bears full responsibility for the socio-economic, political and other well-being of the Republic of Vestina and its people;

CHAPTER 4. THE STATE STRUCTURE OF THE REPUBLIC OF VESTINA.

Section 1. State bodies and their powers

Article 10. President of the Republic of Vestina

1. The President of the Republic of Vestina is the head of State, its highest official, who determines the main directions of the domestic and foreign policy of the state and represents the Republic of Vestina within the country and in international relations;

2. The President of the Republic of the Vestina is a symbol and guarantor of the unity of the people and state power, the inviolability of the Constitution, human and civil rights and freedoms;

3. The President ensures the coordinated functioning of all branches of government and responsibility;

4. The President has the right to speak on behalf of the people and the state;

5. The President, his honor and dignity are inviolable. Encroachment on the honor and dignity of the President is prosecuted by law;

6. The election of the President shall be carried out in accordance with the constitutional law. The President is elected for a term of 5 years;

7. A citizen of the Republic of Vestina who has reached the age of 35, has a higher education, and is fluent in the state language may be elected President of the Republic of Vestina.

8. The President of the Republic of the Vestina has the right to initiate the adoption of a regulatory legal act or to amend it;

9. The President of the Republic of Vestina is ex officio Commander-in-Chief of the armed forces of the country;

10. The acts of the President of the Republic of the Vestina are Decrees and Orders;

11. The President of the Republic of Vestina independently appoints the General Governor, Governors, Head of the Anti-Corruption Service, Head of the Department of Civil Service Affairs, employees of the Presidential Administration;

12. The President of the Republic of the Vestina puts to the vote of the deputies of the Garacium the candidacy of the Chairman;

13. The right to call a referendum and elections in the Republic of Vestina belongs to the President.

Article 11. The Government of the Republic of Vestina​

1. The Government exercises the executive power of the Republic of Vestina;

2. The Government is formed by the President of the Republic of Vestina;

3. The Government is headed by the General Governor;

4. The members of the Government are the Governors who head the sectoral Governorships;

5. The Government is accountable to the President; 

6. The Government has the right of legislative initiative.

Article 12. Garacium of the Republic of Vestina ​

1. The highest Representative body exercising legislative power in the Republic of Vestina is the Garacium;

2. The Garacium is unicameral;

3. The Garacium is a non-partisan Parliament;

4. The Garacium consists of 25 deputies who are elected by self-nomination through direct popular elections;

5. The term of office of the deputies of the Garacium is 5 years.

Article 13. Judicial power

1. Judicial power belongs and is exercised in the Republic of Vestina only by the court. The judicial system is unified.

2. The court, in the execution of justice, is subject only to the Constitution and the Laws of the Republic of Vestina, and is an independent body.

3. Any interference in the activities of the court in the administration of justice is unacceptable and entails legal liability.​
