The Draft Constitutional Law "On the Government" is submitted for public discussion in accordance with the political reforms being carried out in the country.
Review period: until January 7, 2024.
CHAPTER 1. GENERAL PROVISIONS
Article 1. Status of the Government of the Republic of Vestina
1. The Government is a collegial body that exercises and heads executive power in the Republic of Vestina.
Article 2. Procedure for the formation of the Government of the Republic of Vestina
1. The Government of the Republic of Vestina is formed by the President of the Republic of Vestina.
2. The nomination of candidates for the post of Governors of sectoral departments is carried out by the Most High Governor.
Article 3. Structure of the Government of the Republic of Vestina
1. The structure of the Government shall consist of the following sectoral departments:
Office of the General Governor
Governorate of Foreign Affairs of the Republic of Vestina
Governorate of National Economy and Finance
Governorate of Justice
Governorate of Education and Science
Governorate of Communications and Information
Governorate of Culture
Governorate of Digital Development
Governorate of Citizenship Affairs
Article 4. Term of office of the Government of the Republic of Vestina
1. The term of office of the Government of the Republic of Vestina is 5 years.
2. In the event of resignation or resignation, the Government of the Republic shall perform its duties until the approval of a new composition of the Government.
Article 5. Procedure for the resignation of the Government of the Republic of Vestina
1. The Government of the Republic of Vestina or an individual member thereof may declare their resignation if they believe that they are unable to perform the duties assigned to them.
2. An application for the resignation of the Government or an individual member thereof shall be submitted to the President of the Republic of Vestina and shall be considered within 3 working days.
Article 6. Procedure for termination of powers of a member of the Government of the Republic of Vestina
1. In the event of a member of the Government being dismissed from office or submitting a resignation request, the duties must be performed until a new candidate is appointed.
CHAPTER 2. COMPETENCE OF THE GOVERNMENT OF THE REPUBLIC OF VESTINA
Article 7. Competence of the Government of the Republic of Vestina
1. The Government of the Republic of Vestina has competence in relations with state bodies.
2. The competence of the Government is determined by this law and other normative legal acts.
3. The competence of the Government in relation to local executive bodies is determined as a central government body acting both directly and through the Secretariat for the Administration of Sub-Islands and Territorial Possessions of the Republic of Vestina.
4. The competence of the Government in relations with the President of the Republic of Vestina is determined by the implementation of a single state policy and reporting to the President.
5. The Government of the Republic of Vestina:
- develops the main directions of the socio-economic policy of the state, its defense capability, security, public order and organizes their implementation;
- develops measures to implement the foreign policy of the Republic;
- submits the republican budget and a report on its execution to the Garatzium, ensures budget execution;
- determines the procedure for drawing up and submitting the annual report on the execution of the republican budget;
- organizes the management of state property, develops and implements measures for its use, ensures the protection of state property rights;
- forms the system and conditions of remuneration, social protection of citizens, state social security and social insurance;
- develops the main directions of state regional policy;
- makes decisions on holding negotiations and signing intergovernmental agreements;
- ensures the development of relations between the Republic and foreign states, international and regional organizations; develops measures for the implementation of foreign economic policy;
- takes measures to develop foreign trade; carries out cooperation and interaction with international financial organizations.
Article 8. Acts of the Government of the Republic of Vestina
1. The Government, within its competence, issues decrees.
2. Government decrees are adopted by a majority of the total number of votes of the members of the Government and signed by the General Governor.
3. Governors of sectoral departments issue Orders.
4. The Supreme Governor, within his competence, issues Directives.
5. The President of the Republic of Vestina has the right to veto and cancel a Government decree or an order of the General Governor.
Статья 9. Ответственность Правительства Республики Вестина
1. Правительство Республики Вестина несёт коллегиальную и персональную ответственность за осуществление и реализацию государственной политики.
2. Правительство подотчётно в своей деятельности перед Президентом Республики Вестина и Гарациумом.
ГЛАВА 3. ОТНОШЕНИЯ ПРАВИТЕЛЬСТВА РЕСПУБЛИКИ ВЕСТИНА С ЦЕНТРАЛЬНЫМИ И МЕСТНЫМИ ГОСУДАРСТВЕННЫМИ ОРГАНАМИ
Статья 10. Отношения Правительства с Президентом Республики Вестина
1. Правительство предоставляет Президенту ежегодный или же по требованию Главы государства отчёт об итогах деятельности Правительства по реализации государственной политики в целом или же по конкретному направлению дяетельности.
2. Организовывает исполнение и контроль правовых актов Президента как на республиканском уровне, так и на местном.
Статья 11. Отношения Правительства с Гарациумом Республики Вестина
1. Правительство предоставляет Гарацуиму отчёты по итогам исполнения Национального бюджета.
2. Правительство обладает Конституционным правом законодательной инициативы.
3. Обеспечивает исполнение законов Республики, контролирует их исполнение губернаторствами и местными исполнительными органами.
4. Предоставляет ответы на запросы депутатов Гарациума.
Статья 12. Отношения Правительства с местными исполнительными органами
1. Правительство Республики Вестина осуществляет руководство деятельностью местных исполнительных органов Вестины по вопросам государственного управления, контролирует исполнение ими законов, актов Президента и Правительства Республики;
2. Отменяет либо приостанавливает полностью или в части действие актов местных исполнительных органов, вносит предложения об их отмене либо приостановлении на рассмотрение Президента Республики.
ГЛАВА 4. ОРГАНИЗАЦИЯ ДЕЯТЕЛЬНОСТИ ПРАВИТЕЛЬСТВА РЕСПУБЛИКИ ВЕСТИНА
Статья 13. Заседания Правительства
1. Заседания Правительства Республики Вестина проходя еженедельно не меньше двух раз в неделю.
2. Заседания Правительства созываются Наиглавнейшим Губернатором либо Президентом Республики Вестина.
3. На заседаниях Правительства председательствует Наиглавнейший Губернатор, а в его отсутствие – Вице-Наиглавнейший Губернатор. При рассмотрении Правительством особо важных вопросов на его заседаниях при необходимости председательствует Президент Республики.
4. Заседания Правительства являются открытыми. По инициативе Президента либо Наиглавнейшего Губернатора могут проводиться закрытые заседания Правительства.

Статья 14. Наиглавнейший Губернатор Республики Вестина
1. Наиглавнейший Губернатор возглавляет Правительство.
2. Организует работу Правительства и распределяет функциональные обязанности между членами Правительства.
3. Вносит Президенту Республики представления: о структуре и составе Правительства.
4. Докладывает Президенту и Парламенту об основных направлениях деятельности Правительства и о всех его важнейших решениях;
5. Заслушивает отчеты членов Правительства и руководителей местных исполнительных органов.
6. Образует и упраздняет консультативно-совещательные органы при Правительстве.
Статья 15. Аппарат Наиглавнейшего губернатора
Органом, регулирующим и обеспечивающим деятельность Наиглавнейшего губернатора является Аппарат Наиглавнейшего губернатора.
ГЛАВА 5. АКТЫ ПРАВИТЕЛЬСТВА РЕСПУБЛИКИ ВЕСТИНА
Статья 16. Постановления Правительства Республики Вестина
1. Правительство Республики на основе и во исполнение Конституции Республики, законов, актов Президента, иных нормативных правовых актов издает нормативные и индивидуальные постановления.
2. Для правомочности Постановления Правительства в нём должны быть указаны должности и данные присутствовавших членов Правительства, а также их подписи.
Статья 17. Распоряжения Наиглавнейшего Губернатора Республики Вестина
1. Наиглавнейший Губернатор Республики издает распоряжения. Распоряжения Наиглавнейшего Губернатора издаются по вопросам административно- распорядительного, оперативного и индивидуального характера.
