On the submission to the Garacium of the Project Constitutional Law of the Republic of Vestina «On Elections and Referendums»

       In accordance with paragraph 8, Article 11 of the Constitution of the Republic of Vestina,

I DECREE:

1. Submit a project to the Garacium of the Republic of Vestina for consideration  The Constitutional Law of the Republic of Vestina "On Elections and Referendums".

The decree comes into force from the moment of signing

"About the elections and the referendum" 

Article 1. Freedom of elections in the Republic of Vestina

Elections in the Republic are based on the free exercise by a citizen of the Republic of his right to vote and be elected.

Article 2. Principles of electoral law

1. Elections of the President of the Republic, deputies of Gerasim and governors of the sub-islands, as well as a republican referendum shall be held on the basis of universal, equal and direct suffrage by secret ballot.

2. The participation of citizens of the Republic in elections is voluntary. No one has the right to force a citizen to participate or not participate in elections, as well as to restrict his expression of will.

Article 3. Secret ballot

Voting in the elections of the President of the Republic, deputies of Geracium and governors of the sub-islands of the Republic, as well as in the republican referendum, is secret, excluding the possibility of any control over the expression of the will of voters.

Article 4. Procedure for holding elections and referendums

1. Elections of any level in the Republic of Vestina are held only when using an Electronic Election Platform;

2. The republican referendum in the Republic of Vestina is also held exclusively using the Electronic Election Platform.

Article 5 . Electronic election platform

1. The "Electronic platform of the electoral process "Delict" has been developed, approved and operates in the Republic of Vestina.

2. The electronic platform of the electoral process "Delict" is constantly available at the web address:  https://vestinagov.wixsite.com/delict

Article 6. The electoral system

1. In the election of the President of the Republic of Vestina, the candidate is considered elected:

- who received more than fifty percent of the votes of the voters who took part in the voting;

- the person who received a higher number of votes of the voters who took part in the voting during the repeat vote compared to another candidate.

2. In the election of deputies of the Garacium, candidates are considered elected:

Of the 55 candidates nominated for voting, the 25 candidates with the highest percentage of votes are selected.

3. In the election of Governors of sub-islands, the candidate is considered elected:

Who received more than 50% of the votes of the residents of the territorial unit who took part in the voting.

4. When holding a republican referendum, the issue put to the vote is considered resolved according to the answer of the ballot that received more than 50% of the total number of votes.

Article 7. The Central Election Committee of the Republic of Vestina

1. The Central Election Committee heads the unified system of electoral bodies of the Republic and is a permanent body.

2. The Central Election Committee consists of a Chairman and five members.

The Deputy Chairman and Secretary of the Central Election Committee are elected at a meeting of the committee.

3. The Central Election Committee has its own staff.

Article 9. Powers of the Central Election Committee

      The Central Election Committee of the Republic of Vestina:

1) exercises control over the implementation of election legislation in the territory of the Republic; ensures its uniform application; takes decisions within its competence that are mandatory throughout the territory of the Republic;

2) organizes the preparation and conduct of elections of the President, deputies of the Garacium, directs the organization and conduct of elections of Governors of sub-islands, holding a republican referendum.

3) Summarizes and announces the official results of the elections and the republican referendum;

4) Carries out registration of presidential candidates, deputies of the Garacium and Governors of sub-islands;

5) Manages and ensures the technical serviceability of the Electronic Platform of the electoral process.

Article 10. The right to appoint a republican referendum

1. The right to appoint a republican referendum belongs to the President of the Republic of Vestina.
