THE FOREIGN POLICY DOCTRINE OF THE ISLAND STATE OF THE REPUBLIC OF VESTINA
CHAPTER 1. GENERAL PROVISIONS
Article 1. The legal force and significance of the Foreign Policy Doctrine of the Republic of Vestina
1. The Foreign Policy doctrine is a fundamental document regulating the principles and objectives of the implementation of foreign policy.
2. When carrying out diplomatic activities and activities for the implementation of foreign policy, authorized state bodies are obliged to be guided by the provisions of this Doctrine.
3. Normative legal acts, acts of state bodies in the field of international relations, diplomatic activities and the implementation of international obligations of the Republic of the Vestina must comply with and not contradict the provisions of this Doctrine.
4. Compliance with the provisions of this doctrine is obligatory for all citizens of the Republic of the Vestina, state bodies, legal entities and public associations.
Article 2. Goals and objectives of the foreign policy activity of the Republic of Vestina
1. The foreign policy efforts of the Republic of Vestinaa should be aimed at achieving the following goals:
I. Comprehensive strengthening of independence, defense capability, national security, sovereignty and territorial integrity of the country;
II. Upholding a just and democratic world order;
III. Strengthening the unity of a multinational society, the rule of law and democratic institutions, and the realization of human rights and freedoms;
2. The achievement of goals determines the formulation and implementation of the following tasks:
1) improving the effectiveness of global and regional security systems;
2) deepening comprehensive cooperation with foreign partners and international organizations;
3) all-round promotion of the economic interests of the Republic of Vestina in the international arena;
4) preservation of national and cultural identity and following one's own path of further development of the state and civil society;
5) protection of personal and family rights of citizens and business interests of legal entities of the Republic of Vestina abroad;
6) support of the Vestinian diaspora and the Vestinian language abroad;
7) strengthening of the international position of Vestina a and the formation of a positive image of the country in the world community, ensuring information independence and security.
Article 3. International obligations of the Republic of Vestina and the procedure for their fulfillment
1. The international obligations of the Republic of Vestina arise from international treaties concluded and ratified
by the Republic of Vestina.
2. The Republic of Vestina is responsible for the fulfillment of the obligations assumed within the framework of the concluded international agreement.
3. The procedure for the fulfillment of international obligations assumed by the Republic of Vestina is regulated by the Law of the Republic of Vestina "On International Treaties", the Constitution of the Republic of Vestina, the provisions of this Doctrine (in part of the article.. "The procedurefor concluding international treaties, their ratification and execution").
4. The Republic of Vestina has the right to default on obligations arising from international treaties that have been
ratified by it if they contradict the national legislation of the Republic of Vestina and its national interests and
principles. When making a decision on non-fulfillment of certain obligations, the authorized state bodies of the Republic
The Vestina must notify the second party to the international agreement about this.
5. It is established that it is impossible for the Republic of Vestina to conclude an international treaty and other document, the obligations of which completely contradict the legislation of the Republic, encroach on the independence, sovereignty, security and stability of the Republic of Vestina;
Article 4. Legal bases of foreign policy activity
1. The foreign policy activity of the Republic of Vestina is based on the provisions of the Constitution of the Republic of Vesti, this Doctrine and other legislative acts having provisions on foreign policy and international relations
CHAPTER 2. STATE BODIES OF FOREIGN POLICY ACTIVITY
Article 5. State bodies authorized to carry out foreign policy activities
1. The central foreign policy department, which carries out international activities and heads the unified system of bodies of the country's diplomatic service, is the Governorate of Foreign Affairs of the Republic of Vestina.
2. The main directions of foreign policy are determined by the President of the Republic of Vestina.
3. The main state body exercising the authority to interact with international organizations on behalf of the Governorate of Foreign Affairs (GID) of the Republic of Vestina is the Organization of International Cooperation under the GID of the Republic of Vestina;
4. The diplomatic mission carrying out the representation of the Republic of Vestina in the host State, headed by an Ambassador Extraordinary and Plenipotentiary accredited to the Head of State, is the Embassy of the Republic of Vestina;
5. The Permanent Mission of the Republic of Vestina to an international organization is a foreign institution of the Republic of Vestina, equated to a diplomatic mission, representing the Republic of Vestina in an international organization of which the Republic of Vestina is a member, headed by a Permanent Representative;
CHAPTER 3. NON-GOVERNMENTAL AND QUASI-GOVERNMENTAL BODIES OF FOREIGN POLICY ACTIVITY
Article 6. Status of public associations and international organizations
Public associations, international organizations and organizations whose activities contribute to the development of the system of international relations of the Republic of Vestina, the implementation of its foreign policy goals and objectives, are recognized by bodies of the quasi-public sector of foreign policy activities.
CHAPTER 4. PRINCIPLES OF FOREIGN POLICY ACTIVITIES
Article 7. Basic principles of foreign policy activity
The Republic of Vestina implements its foreign policy on the basis of the following basic principles:
- Assistance in building a stable, just and democratic world order;
- equal integration into the global political, economic and humanitarian space;
- effective protection of the rights, freedoms and legitimate interests of citizens of Vestina and compatriots living abroad;
- promoting the external openness of the state, creating favorable external conditions for improving the well-being of the Vestinians, developing the political, economic and spiritual potential of the country.
Article 8. Principles of cooperation with other countries and establishment of diplomatic relations
1. The establishment of diplomatic relations with the Republic of Vestina is allowed if the established agreements and the political position of the other party correspond to the main foreign policy characteristics established by this doctrine. The main characteristics of a potential ally state are:
1) The interests of the state are above all personal ones;
2) A fair society and the distribution of power;
3) The State conducts an open and peaceful policy towards other countries;
4) The country respects the traditions, culture and language of other states and peoples (both inside and outside the country);
5) The state is politically stable;
6) The State is committed to active cooperation with the Republic of Vestina and to the clear, disciplined fulfillment of obligations imposed as a result of bilateral agreements;
7) The State undertakes to treat the allied countries with respect.
2. The Republic of Vestina may not provide military assistance to other States under any circumstances, in view of the existing constitutional provision – article 29 of the Constitution of the Republic of Vestina.
3. When concluding diplomatic relations, the Republic of Vestina establishes three main provisions on bilateral cooperation (the content of the Agreement):
I. The island State of the Republic of Vestina and the foreign State mutually recognize independence and sovereignty;
II. The island State of the Republic of Vestina and a foreign State establish diplomatic relations in accordance with International law;
III. The countries commit themselves to maintaining friendly and peaceful relations.
It is allowed, by agreement of the parties, to supplement the contract with other clauses, but the three above paragraphs are basic and unchanged.
Article 9. Approval and publication of the official list of countries- allies of the Republic of Vestina
1. The President of the Republic of Vestina approves the official list of Allied countries on a monthly basis on the recommendation of the Governor of Foreign Affairs of the Republic of Vestina;
2. The list of allied countries includes those countries that provide active and friendly cooperation with the Republic of Vestina and are priority partners in foreign policy activities.
3. Not including any country in the list of allied countries is not a reason to break or escalate relations between countries.
4. After the approval of the list of allied countries by the President, the Decree approving the list and the list itself must be published on the President's website.
CHAPTER 5. THE PROCEDURE FOR CONCLUDING INTERNATIONAL TREATIES, DIPLOMATIC AND OTHER DOCUMENTS
Article 10. International treaties of the Republic of Vestina are concluded with foreign states and (or) international organizations on behalf of:
1) The Republic of the Vestina;
2) The Government of the Republic of Vestina;
3) State bodies of foreign policy activity;
Article 11. Types of international agreements, diplomatic and other documents allowed to be concluded by the Republic of Vestina
1. Agreements on the establishment of diplomatic relations and mutual recognition with a foreign state (exchange of notes); 2. International agreements (with organizations);
3. Foreign economic contracts (trade contracts).
Article 12. Conditions that do not allow or prohibit the conclusion of international and diplomatic treaties of the Republic of Vestina
1. If the concluded agreement violates the legislation of the Republic of Vestina, contradicts the statutory principles of the Republic, threatens its integrity, sovereignty, independence and security, its conclusion is prohibited
2. If the concluded international agreement provides for obligations that contradict the statutory principles or national interests, the Republic of Vestina has the right to refuse to fulfill them by notifying the other party.
CHAPTER 6. PUBLICATION, REGISTRATION, ACCOUNTING AND STORAGE OF INTERNATIONAL TREATIES OF THE REPUBLIC OF VESTINA
Article 13. Publication of international treaties of the Republic of Vestina
Which have entered into force, as well as temporarily applicable international treaties of the Republic of Vestina are published on the proposal of the Governorate of Foreign Affairs on the official website of the President of the Republic of Vestina, GIS "Open Government", the official website of the Governorate of Foreign Affairs.
Article 14. Registration, accounting and storage of international treaties and Diplomatic documents
The Unified State System of Registration, Accounting and Storage of International Treaties and Diplomatic Documents of Republic of Vestina is under the jurisdiction of the Governorate of Foreign Affairs of the Republic of Vestina.
